I’ve got some more details about the recent news that Azoogle entered into an agreement with the Florida Attorney General’s Economic Crimes Division.

I spoke with Jonathan Gillman and Will Haselden of the newly formed Cyberfraud Task Force in the Florida Attorney General’s Economic Crimes Division, who were at ad:tech this week, and they explained that the agreement with Azoogle sets a new standard for the way affiliates market cell phone products.

Consider this new standard to be in effect now.

According to these folks from the Cyberfraud Task Force, they received substantial cooperation from Azoogle in coming to this agreement on how cell phone products must be advertised.

Any affiliates and networks marketing ringtones and other cell phone products should definitely become well acquainted with this agreement.

Here are two key points, though I would suggest reviewing the document in its entirety:

  1. The use of “free” must include the price and term.
  2. The price point must be immediately adjacent to the cell submit and pin submit.

Interesting b/c I came upon their official company statement in a few places. I trust them a lot and also think this is a great move for them. Here’s their statement that i found:

The Florida Attorney General (FLAG) announced that they have entered into a cooperation agreement with AzoogleAds. AzoogleAds has volunteered to work closely with the Attorney General’s newly-created “Cyber Fraud Task Force” to further its efforts to combat illicit online advertising and to help establish a more transparent and accountable marketplace.

As part of its cooperation, AzoogleAds will voluntarily contribute $1MM to the task force’s ongoing legal and investigative fund; this contribution is not a reprimand for wrong-doing but rather reinforces AzoogleAds’ commitment to improving industry standards in the fight against fraudulent and deceptive internet advertising and exhibits its total commitment to internet compliance leadership not just in the mobile marketing vertical but all verticals.

Over the past several years, AzoogleAds has been actively engaged in maintaining the highest level of ethical standards in the industry and is currently a member of several professional organizations in helping to lead the industry in this fashion. Their exemplary compliance efforts have put them in a position to help the FLAG police and monitor the industry going forward like no other partner could.

AzoogleAds’ Integrity Assurance Program, along with other examples of their continuing work in the area of compliance, is available online at http://www.AzoogleAds.com.
